Welcome to the website (the “Website”) operated by Pepper’s Dog Sanctuary, a Colorado nonprofit corporation (“Pepper’s”, “we”, or “us”), which includes our Website and any content, functionality, and services offered on or through the Website, including any donations made through the Website and the creation of either a donor or volunteer account through the Website (collectively the, “Services”). These Terms of Use (the “Terms of Use”) govern your access to and use of the Website and the Services of Pepper’s. The Terms of Use include and incorporate by reference Pepper’s Privacy Policy available at https://www.psds.org/pages/privacy-policy (the “Privacy Policy”) and the [_____] (the “Terms of Sale”). Please read the Terms of Use and Privacy Policy carefully and fully before using the Services or disclosing to us any personal information. By using the Website you accept and agree to be bound and abide by these Terms of Use and the Privacy Policy. The Services offered and available to users who are 13 years of age or older. By using our Services, you represent and warrant that you meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Services.

You agree that all information you provide to register with this Website or otherwise, including, but not limited to, through the use of any interactive features on the Website, is governed by our Privacy Policy, and you consent to all actions we take with respect to your information consistent with our Privacy Policy.
If you choose, or are provided with, a user name, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any other person or entity. You also acknowledge that your account is personal to you and agree not to provide any other person with access to this Website or portions of it using your user name, password or other security information. You agree to notify us immediately of any unauthorized access to or use of your user name or password or any other breach of security. You also agree to ensure that you exit from your account at the end of each session. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information.

User Generated Content
You may be allowed to post, submit, publish, display, or transmit to other users or other persons, or otherwise provide (hereinafter, “Post”), content, videos, materials, or other data (collectively, “User Content”) on, to, or through the Services. All User Content must comply with the Content Standards set out in these Terms of Use.
We do not claim ownership of User Content; provided, however, that when you (as a user) Post or otherwise make available User Content on the Services, you represent that you own and/or have a royalty-free, perpetual, irrevocable, worldwide, non-exclusive right (including moral rights) and license to use, sublicense, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, derive revenue from, and communicate to the public, perform and display User Content, and all portions thereof, and to incorporate it in other works in any form, media or technology now known or later developed, for the full term of all worldwide intellectual property rights that may exist in User Content. User Content Standards
These content standards apply to any and all User Content. User Content must comply with all applicable federal, state, local, and international laws and regulations. Please do not create and use multiple accounts for the purpose of disrupting the community or to annoy other users. Without limiting the foregoing, User Content must not:
Contain any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable against other individuals or other animal welfare organizations;
Promote sexually explicit material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age;

You understand and agree that all User Content is the sole responsibility of the person who Posted the User Content. You acknowledge that we have no obligation to pre-screen User Content, but we reserve the right, in our sole discretion, to pre-screen, refuse, or remove any User Content. By accepting these Terms of Use, you hereby provide your irrevocable consent to such monitoring, and you acknowledge and agree that you have no expectation of privacy concerning the transmission of User Content. In the event that we pre-screen, refuse or remove any User Content, you acknowledge that we will do so for our benefit and not yours. Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.

Governing Law and Jurisdiction

No waiver of by Pepper’s of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Pepper’s to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.
If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.
Entire Agreement
The Terms of Use, our Privacy Policy, and our Terms of Sale constitute the sole and entire agreement between you and Pepper’s with respect to the Services and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Services.
